LIABILITY WAIVER

Aerial Fitness Factory Liability Waiver and Acknowledgment of Risk: 

I understand and agree that in participating in any dance class, workshop, rehearsal or performance, there is a possibility of physical injury or death. I voluntarily agree, therefore, to assume all risks and responsibility for any such injury or accident, which might occur to me or my child during any of Aerial Fitness Factory classes, rehearsals, performances, or activities. I also exempt, release, and indemnify Aerial Fitness Factory, its owners, agents, volunteers, assistants, employees, guest artists, faculty members, and/or students from any and all liability claims, demands, or causes of action whatsoever from any damage, loss, injury, or death to me, my children, or property which may arise out of or in connection with participation in any classes or activities conducted by Aerial Fitness Factory. I further hereby voluntarily agree to waive my rights and that of my heirs and assigns to hold Aerial Fitness Factory, its owners, agents, volunteers, assistants, employees, guest artists, faculty members, and/or students liable for such damage, loss, injury, or death. I understand that I should be aware of my physical limitations and agree not to exceed them. I agree to inform my instructor if I have sustained any injuries, illnesses or medical conditions. If I am signing this waiver for my children, I certify that I am the parent or legal guardian and have the right to waive these rights. Permission is granted Aerial Fitness Factory to use photographs of students for publicity purposes. I have read, understood and agree to be bound by the above statement. The owner reserves the right of admission.

 

TERMS & CONDITIONS

Terms and conditions between the student and Aerial Fitness Factory:

-First month or pro rata thereof and registration to be made via cash or EFT.
-All monthly payments will be made via debit order agreement on or before the 1st of the month.
-Contracts will start from the beginning of the new month. Should you join Aerial Fitness Factory mid-way through the month you will be charged a pro-rata of your agreed contract rate for the initial month, and your contract will begin on the 1st day of the new month.
-A registration fee will be payable initially with the 1st payment. The registration fee will not be payable again should the student renew their contract. 
-All contracts and debit order mandates will continue to run on a month to month basis at the current contract rate after the minimum term has concluded and 30 days written notice has been given to Aerial Fitness Factory in writing via email to info@aerialfitnessfactory.co.za. November will not be accepted as a notice month.
-You agree that per CPA, any contract which is terminated prematurely will be charged a cancellation fee based on the outstanding term on the account.
-No contract can be postponed to a later date, even if the student cannot attend classes.
-The studio will be closed in December/January. Full fees will be payable for these months.
-The studio will be closed over public holidays.
-The student will be registered for the set classes as agreed and no deviation will be made unless agreed by in writing by both parties.
-No student will be able to participate in classes where payments are not up to date. The student will however be held liable for the duration of the contract despite your absence from classes.
-No refunds will be given to the student for any classes not attended on their part.
-No refunds will be given for upfront payments.
-Failure to effect payment in accordance with the terms contained above will result in the studio refusing the student further participation and sending a letter of demand, requesting them to remedy the position. They will be afforded 7 day herein to attend to the same.
-Failure to comply with the demand will result in Aerial Fitness Factory handling the matter over to its attorneys for collection of the outstanding amount plus interest per law. The student will further be held liable for all attorney costs, including fees, disbursements and collection commission on an attorney and own client scale.
-All costs incurred for debt collection will be for the students account.
-Studio fees are subject to an annual increase. Students will be notified via email prior to increase. All debit orders will be adjusted automatically and accordingly.
-The student consents to the jurisdiction of the Magistrate Course.
-The student consents to a credit check.
-The student agrees to disclose any medical issues, pregnancy, injuries etc. initially and also to advise Aerial Fitness Factory should they incur a recent medical condition during the course of their contract.
-The student understands that even full disclosure of medical history will not give them any rights to hold Aerial Fitness Factory, its members, employees and or students in relation to any medical issues which they may incur.
-We record that our classes are physically demanding and do carry risk. The student warrants that they are physically and medically fit to attend classes and that they waive any claim against Aerial Fitness Factory, its members, employees, consultants and or students to any loss, damage or bodily harm arising from their participation or attendance of classes on the premises of Aerial Fitness Factory.
-Should the student at any time feel dizzy or ill, they should advise the instructor and refrain from further participation in the classes until they feel well enough.
-The student further warrants that they shall not have any claim against Aerial Fitness Factory, its members, its negligence in respect of your person or property while on the premises.
-The student understands that class times and days may change from time to time however notification of the same will be provided timelessly to occasion with as little disruption as possible. Should the studio not be able to accommodate a specific time slot and the student does not find a suitable time slot which is suitable, the studio agrees to render the contract null and void.
-The student agrees to adhere to the instruction of the trainer at all times.
-The student agrees where there is any change to the contact details contained above that they will advise Aerial Fitness Factory.
-In case of a student, who is a minor and may not contract in terms of law, the minor will be required to obtain permission and consent of their parents/ legal guardian.
-The parents will be required to accept and sign this agreement and held liable for the terms and conditions stated above.
-Rights of admission reserved by the owner of Aerial Fitness Factory.
I further agree that all the information above is true and correct.

Housekeeping Rules

 

  • Aerial dance is a disciplined art form and requires a serious approach. Being punctual is a part of this discipline, therefore should a student arrive 15 minutes late for any scheduled class they will not be allowed to join the class.

  • Please note that all shoes, bags and clothing are to be kept in the area behind the black curtain.

  • All grip aids, water bottles, towels or anything else that you may require during your lesson should be placed against the wall out of the main training area.

  • No jewellery, watches are allowed when participating in any Aerial or Pole Fitness Class and should be removed before the lesson starts.

  • The use of a safety at is not negotiable. All students practising Aerial Arts must have a safety mat underneath them at all times.

  • Make sure you have water available to drink during or after a class, however food will not be allowed in the studio.

  • We would appreciate it if there are no unnecessary interruptions during a class.  All administrative queries may be discussed with the administrative lady before and after class.

  • You will be allowed to take photos in the last 5 minutes of each class.

  • NO SPECTATORS ARE ALLOWED TO SIT IN AT ANY OF THE CLASSES, If the student is under 18 a PARENT/GUARDIAN is allowed to sit in on the last lesson of the month.

  • All Aerial Fitness Factory fees are payable in advance.

  • Aerial Fitness Factory will be closed for two weeks over the December holidays, please be aware that you are still obliged to pay the full fee for December.

  • We are all human, please be respectful to both your fellow students and instructors.  Rudeness will not be tolerated.

  • Only qualified Aerial Fitness Factory Instructors are allowed to give instruction during a class, please do not interfere during a class.

  • Students must be dressed appropriately for the class they are attending and MUST remove all jewellery before class.

  • No students are allowed to make use of any other aerial equipment.  You may only use the apparatus for the class you have specifically signed up for.

  • No student is allowed to make use of any of the aerial apparatus unless they have warmed up with the instructor.

  • Please do not make use of the resin/dry hands that belong to other student without their permission.

  • Aerial Fitness Factory prides itself on the friendly, family & inclusive nature of its classes.

  • Aerial Fitness Factory has a ZERO TOLERANCE for bullying. Any student, parent or staff member seen to be behaving in a way that can be identified as bullying will be dismissed from Aerial Fitness Factory effective immediately.

Student Safety Policy

  • Aerial Fitness Factory is committed to student safety.

  • We want students to be safe, happy and empowered. We support and respect all students, as well as our staff and volunteers.

  • We are committed to the safety, participation and empowerment of all students.

  • We have zero tolerance of student abuse, and all allegations and safety concerns will be treated very seriously.

  • Aerial Fitness Factory is committed to preventing student abuse and identifying risks early, and removing and reducing these risks.

  • We support and respect all students, as well as our staff and volunteers.

  • We have specific policies, procedures and training in place that support our leadership team, staff and volunteers to achieve these commitments.

  • We are aware of the inherent risks associated with pole and aerial schools and we continue to evaluate these risks and implement solutions to keep our students safe.

  • We are committed to providing an environment where all students feel valued and can learn in a supportive atmosphere regardless of their skill level.

  • We are committed to employing teachers that uphold these values and we will stop classes and remove teachers should we feel their behaviour is inappropriate.

  • We lead on student safety from the top. Studio owners and key management staff all uphold and practice student safety.

  • Whilst we believe that discipline is important in the pole and aerial training industry, this does not involve yelling in a demeaning manner or isolating, threatening, bullying or victimising students.

  • Each teacher will have very clear expectations for behaviour in class and this will be communicated directly to students, whilst all students are expected to comply with these expectations, we must all agree that they are fair and just.

  • Parents are an important part of our pole and aerial community and should always feel their children are safe. We expect all parents and carers to uphold the student safe standards and code of conduct.

  • Our policies are well communicated to all staff, volunteers, students, families and members of the community.

  • We are committed to the holistic development of the students in our care and endeavour to incorporate discussions, workshops, displays and good teaching practice on health and wellbeing. This includes physical, mental and emotional health.

  • We have zero tolerance of bullying and regularly work with our staff, teachers and students to ensure this is embedded in our culture.

  • We are committed to continually improving our facilities to ensure the safety of our students and to remove all risks of student abuse.

Code of Conduct

All staff, volunteers and board members of Aerial Fitness Factory are required to observe student safe principles and expectations for appropriate behaviour towards and in the company of students, as noted below.

All personnel of Aerial Fitness Factory are responsible for supporting the safety, participation, wellbeing and empowerment of students by:

  • adhering to Aerial Fitness Factory student safe policy at all times

  • taking all reasonable steps to protect students from abuse

  • treating everyone with respect

  • listening and responding to the views and concerns of students, particularly if they are telling you that they or another student has been abused and/or are worried about their safety or the safety of another

  • encouraging students to “have a say” and participate in all relevant organisational activities where possible, especially on issues that are important to them.

STAFF AND VOLUNTEERS MUST NOT:

  • develop any “special” relationships with students that could be seen as favouritism (for example, the offering of gifts or special treatment for specific students)

  • exhibit behaviours with students which may be construed as unnecessarily physical. It is understood that physical contact in the pole and aerial environment is important, for example correcting a student’s position of arms or feet however this will be appropriate physical contact with no sexual or abusive intention

  • engage in open discussions of a mature or adult nature in the presence of students underage (for example, personal social activities)

  • use inappropriate language in the presence of students

  • express personal views on cultures, race or sexuality in the presence of students.

  • discriminate against any student, including because of culture, race, ethnicity or disability

  • attend work under the influence of drugs and/or alcohol or discuss the use of these with any students.

  • have contact with a student or their family outside of Aerial Fitness Factory without the owner’s consent, knowledge and/or consent. Accidental contact, such as seeing people in the street, is appropriate

  • have any online contact with a student or their family unless necessary.

  • ignore or disregard any suspected or disclosed student abuse

  • yell at students in a demeaning manner

  • ignore, threaten, isolate, bully or intimidate students.

Failure to comply with this code of conduct where a staff member (teaching or nonteaching) casual relief staff, volunteers, contractors, parents or carers are suspected of breaching any obligation, duty or responsibility within this policy, Aerial Fitness Factory will take disciplinary action, including in the case of serious breaches, summary dismissal.
